Agreeing to these terms

These terms are a contract between you and Haven Report ("we", "us"). They apply when you run a free scan, buy a report or an assessment, request a call, or send us an enquiry. If you are doing any of that for a company, you are confirming that you may accept these terms on that company's behalf. If you do not agree to them, please do not use the service.

Two sections below change your legal rights and are worth reading properly: Limitation of liability and Disputes and arbitration, which includes a waiver of class actions and of trial by jury.

What the scan is

The free scan and the paid detailed report are produced by automated analysis of publicly accessible pages of the website address you provide. They are informational. They are not a professional consulting engagement, an audit, a security assessment, a penetration test, or legal, financial, accounting or tax advice. Nothing in a report creates a professional, fiduciary or advisory relationship between us, and you should not rely on a report as a substitute for advice from someone you have retained.

The $999 In-Depth AI Business Assessment is a service performed by people. It is still advisory: we give you our analysis and our opinion, and decisions about your business remain yours.

How the analysis works, and where AI fits

Findings are produced by fixed rules applied to the page content we fetched, not invented by a language model. Where a report is phrased for your business, an AI system is used for the wording only, working from findings that are already settled. We think that is the honest way to do it, but no automated system is perfect: AI-assisted text can still contain mistakes, and you should read a report as a starting point for your own judgement rather than as verified fact.

Findings are labelled by how certain we are: "verified" where we can quote the page source, "potential" where we looked and did not detect something that may still exist, and "recommended investigation" where a website cannot show the answer at all. We do not warrant that a report is complete, current or free of error, and you should verify anything you intend to act on.

No guarantee of results

We do not guarantee revenue, savings, rankings, traffic, leads, cost reductions, or any other outcome. Where a report contains an estimate, it is an illustration based on assumptions that are stated alongside it, usually assumptions you supply. It is not a forecast, a projection, or a promise. Any decision you take after reading a report — including spending money on tools, staff or implementation — is your decision and at your own risk.

What you're telling us when you submit a website

By submitting a website address you confirm that you own that website or are otherwise authorised to request an automated analysis of it, and that doing so will not breach anyone else's rights or any agreement you are under. Please do not submit websites belonging to others without permission. You are responsible for this confirmation, and the indemnity below applies if it turns out to be wrong.

You also confirm that any email address or phone number you give us is yours, or that you are authorised to provide it and to consent to contact at it.

Emails and text messages

When you run a scan you agree to receive your report by email, plus a short series of follow-up emails about it. Every one of those emails has a one-click unsubscribe link, and unsubscribing stops them immediately. We do not sell or rent your details.

Text messages are separate and always optional. We only text you if you ticked the specific SMS box on a form, and consent to texts is never a condition of running a scan, of any purchase, or of anything else we do. If you do consent:

  • Messages come from Haven Report and may be sent using automated technology.
  • Message frequency varies. We do not send a fixed number.
  • Message and data rates may apply. Those are between you and your carrier.
  • Reply STOP to any message to cancel, or HELP for help. You can also email us and we will remove your number.
  • Carriers are not liable for delayed or undelivered messages.

We keep a record of the consent you gave, including the date and the exact wording you were shown, so that both of us can check later what was actually agreed.

Payments and refunds

Payments are processed by Stripe. We never receive or store your card details. Prices are in US dollars and exclude any taxes that may apply to you.

The detailed report is generated immediately after payment, at the price shown at checkout. If it fails to generate, or if you are not satisfied with it, email us within 14 days and we will refund it.

The $999 In-Depth AI Business Assessment is refundable in full before work begins. Once the kickoff conversation has taken place, refunds are considered case by case and in good faith — write to us and we will sort it out. Implementation work is quoted and agreed separately, and those terms will say what applies.

Chargebacks filed without contacting us first cost us more than a refund would, so please email us first. We will almost always just refund you.

Your report, and our materials

Reports we produce for you are yours to use inside your business however you like, including sharing them with your own staff and advisers. We keep a copy so we can answer questions about it later.

Everything that produces those reports — the scanning software, the rules, the analysis method, the templates, the wording of the site and the Haven Report name and marks — remains ours. Nothing here transfers ownership of it. Please do not resell our reports as your own product, copy the report format into a competing service, or scrape, reverse engineer or bulk-extract the analysis.

If you send us feedback or suggestions, we may use them without owing you anything for it.

Acceptable use

Please do not use the scanner to generate load against a third party, to analyse sites you have no connection to in bulk, to attempt to reach non-public systems, or to test or probe our own infrastructure without written permission. We rate-limit scans, use bot protection, and will block misuse.

We may refuse service, cancel a scan, or close an account at any time, for any lawful reason — including a reasonable suspicion of misuse. If we do that and you have paid for something you have not received, we will refund it.

Third parties we rely on

The service runs on infrastructure and tools provided by others — currently Cloudflare (hosting, bot protection), Stripe (payments), Anthropic (AI text generation) and Resend (email delivery). Their handling of data is described in our Privacy Policy. We are not responsible for outages, acts or omissions of those providers beyond our reasonable control, and we may change providers.

Disclaimer of warranties

To the fullest extent permitted by law, the service and every report are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the service will be uninterrupted, timely, secure, error-free, or that any finding is accurate or complete.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. In that case our liability is limited as far as the law permits.

Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, lost business opportunities, or business interruption, even if we were told such damages were possible.
  • Our total liability to you for all claims taken together will not exceed the greater of (a) the amount you actually paid us in the twelve months before the event giving rise to the claim, or (b) US$100.

The free scan is free. If you have paid us nothing, our liability to you is capped at US$100. These limits apply whatever the legal theory — contract, negligence, strict liability or anything else — and are a fundamental part of the agreement between us: we could not offer a free automated scan at this price without them.

Nothing in these terms excludes liability that cannot lawfully be excluded, such as liability for fraud or for death or personal injury caused by negligence.

Indemnity

You agree to defend, indemnify and hold harmless Haven Report and its owners, staff and contractors from any claim, loss, liability, damages and reasonable legal costs arising out of (a) a website address you submitted that you were not authorised to submit, (b) contact details you gave us that were not yours to give, (c) your misuse of the service or breach of these terms, or (d) your use of, or decisions based on, any report.

Disputes and arbitration

Please read this section carefully. It affects how disputes between us are resolved, and it limits your rights to go to court and to take part in a class action.

Talk to us first. Most problems are a misunderstanding or a refund. Before starting any formal proceeding, email hello@myhavenreport.com with a description of the problem and what you would like done. Give us 30 days to sort it out.

Arbitration. If we cannot resolve it, you and we agree that any dispute arising out of or relating to these terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in Placer County, California or, at your election, by telephone, video or on written submissions. Judgment on the award may be entered in any court with jurisdiction.

No class actions. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. An arbitrator may not consolidate more than one person's claims. If this paragraph is found unenforceable as to a particular claim, that claim — and only that claim — will be severed and heard in court.

Small claims. Either of us may instead bring an individual claim in small claims court, if it qualifies.

You can opt out. You may reject this arbitration agreement by emailing hello@myhavenreport.com within 30 days of first accepting these terms, with your name and the email address you used. Opting out affects nothing else in these terms, and we will not treat you any differently for it.

Governing law. These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Where a dispute is not subject to arbitration, you and we submit to the exclusive jurisdiction of the state and federal courts located in Placer County, California.

Time limit. Any claim must be brought within one year after it arises, or it is permanently barred, except where a longer period is required by law.

Changes to these terms

We may update these terms. The "last updated" date at the top will change, and the current version always lives at this address. If a change is significant and you have an active paid engagement with us, we will tell you by email. Continuing to use the service after a change means you accept the updated terms. A change to the arbitration section does not apply retroactively to a dispute we already knew about.

General

If any part of these terms is held unenforceable, the rest stays in force and that part is narrowed only as far as needed. Our not enforcing something is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours to a successor if the business changes hands. These terms, together with the Privacy Policy and any order or statement of work we both sign, are the whole agreement between us about the service, and replace anything said earlier. Nothing here makes either of us the other's partner, agent, employer or joint venturer. Neither of us is liable for failures caused by events outside our reasonable control.
